National Phase application in Mexico must be filed within 30 months counted from the priority date or international filing date (if no priority was claimed) either Chapter I or Chapter II applications. No extension is available.

PCT national phase applications are filed as a Mexican Patent application or a Utility Model, (if the invention lacks of inventiveness).

The specification, claims, abstract and drawings must be submitted in Spanish language.

PCT national phase applications are published in the Mexican Gazette within the following 6 (six) months from filing date.

The Patents and Utility Models derived from PCT applications, have similar process and legal life than regular national applications, that is, 20 years for Patents and 10 years for Utility Models counted from the international filing date.

Data for entering a new PCT Patent application:

– PCT number
– Title of the invention
– Applicant’s name, address (residence) and nationality
– Inventor’s name, address (residence) and nationality.
– Priority data (date, serial number and country)
– Indication of the PCT Chapter to claim (indicate if Preliminary Examination was conducted).

Annuities:

They are due upon granting and must be paid by quinquenniums (5 years term). The first quinquennium is paid along with the granting fees for the current year and the following 4 (four). Next quinquenniums are due every 5 years on the anniversary of the international filing date.
